Terms and Conditions
Wonderful Weddings – Updated March 17, 2024
1. Scope of Terms
1.1 - These terms apply to all agreements between Wonderful Weddings and the customer unless otherwise agreed in writing.
2. Services Provided
2.1 - Services include, depending on the nature of the assignment, photography, video and audio production, video and audio editing, graphic design, photo editing, website design, and consultation. The customer receives a completed product.
3. Agreement Formation
3.1 - Wonderful Weddings’ offers are valid for 14 days from the date of the offer unless otherwise stated.
3.2 - An agreement becomes binding once the customer accepts the offer, e.g., via confirmation by email or text message.
4. Liability
4.1 - Wonderful Weddings is not liable for any loss or damage of any kind.
4.2 - The customer is responsible for backing up all materials, including but not limited to materials sent to Wonderful Weddings as well as the finished product received by the customer.
5. Materials and Copyright
5.1 - Both the customer and Wonderful Weddings retain copyright, ownership, and intellectual property rights over all materials and data in their possession at the time of entering this agreement.
5.2 - Copyright for materials created by Wonderful Weddings remains with Wonderful Weddings unless otherwise agreed. The customer is granted usage rights for private purposes and may not distribute the material without Wonderful Weddings’ consent, except for sharing on social media.
6. Prices and Payment
6.1 - Services are paid according to the terms outlined in the invoice unless otherwise agreed. Invoices are due 8 days after the invoice date. Late payments incur fees and interest from the due date until payment is made.
6.2 - Wonderful Weddings reserves the right to change its standard prices at any time.
6.3 - Prices quoted for private customers include VAT.
6.4 - Work beyond the originally agreed scope (additional work) is always specifically agreed upon between the parties. Wonderful Weddings reserves the right to charge for additional services, such as extra photo editing or video editing.
6.5 - In case of delayed payment, Wonderful Weddings reserves the right to withhold the product until all outstanding amounts are paid. Wonderful Weddings is not obligated to deliver services while the customer is in default.
6.6 - If payment is not made and the customer does not respond to reminders, the claim will be sent to debt collection.
6.7 - If the claim goes to debt collection, the full subscription period becomes due for payment.
6.8 - Expenses incurred by Wonderful Weddings on behalf of the customer must be reimbursed by the customer.
7. Subcontractors
7.1 - Wonderful Weddings is entitled to use subcontractors.
8. Transfer of Rights
8.1 - Neither party may transfer rights and obligations under this agreement without the other party’s consent.
9. Governing Law and Venue
9.1 - The agreement is governed by Danish law. Any disputes arising from this agreement must be resolved amicably between the parties. If this is not possible, disputes will be settled in the Copenhagen City Court as the appropriate venue.
10. Complaints
10.1 - Refunds are NOT provided for products and services delivered by Wonderful Weddings, as they are custom orders.
11. Contract Changes, Rectification, and Delivery
11.1 - If Wonderful Weddings is unable to fulfill the assignment due to injury, illness, accident, or similar circumstances beyond its control, Wonderful Weddings will do everything possible to find a replacement. If no replacement can be found, no compensation can be claimed, but any prepaid amounts will be refunded.
11.2 - Wonderful Weddings is entitled to an extension of deadlines due to force majeure, supplier delays, unusual weather conditions, labor disputes, government restrictions, or other unforeseeable circumstances.
11.3 - If the customer cancels, the 50% paid at the time of booking remains non-refundable. No further payment will be required unless Wonderful Weddings has booked other services on behalf of the client (in agreement with the client).
11.4 - For defects in the delivered service or product for which Wonderful Weddings is responsible, Wonderful Weddings is entitled to remedy, re-deliver, or replace the product at its own discretion. If the remedy fails, Wonderful Weddings is entitled to attempt another rectification.
11.5 - Remedies or re-deliveries will be made within a reasonable time after the customer’s complaint. A period of 21 days is considered reasonable.
12. Force Majeure
12.1 - Delays or defects caused by circumstances beyond Wonderful Weddings’ control, including but not limited to labor disputes, supplier failures, material shortages, and similar events, entitle Wonderful Weddings to postpone delivery or terminate the agreement, provided the customer is informed in due time.
12.2 - Regardless of delays or termination due to force majeure, Wonderful Weddings is entitled to payment for completed work already delivered.
